TSC Web Auction Overview and Rules.

+++ The TSC Web Auction +++

The TSC Auction Site is a site for foreign growers and/or exporters as exhibitors, and Japanese
importers and customers as bidders.TSC runs a transparent auction system, with all products, quotes
and bids visible to all members.


+++ The TSC Web Auction System +++

The TSC Web Auction System operates using the following methods.

The TSC Web Auction Homepage displays the product(s) which exhibitors wish to sell through the auction
system.Once the auction has taken place and the highest bidder is confirmed as the successful buyer,
the successful bid amount (calculated by the final bid price x lot weight x consumer tax) is transferred
to a designated bank account.As soon as fund transfer confirmation is received, the ownership of the
(squash) lot is transferred into the name of the successful bidder.On receiving the successful bid amount
(final bid price x lot weight x consumer tax) TSC Web Auction will deduct it’s commission - then remit
the balance of the money to the exhibitors foreign account.

From the instant ownership is transferred the squash becomes the property of the successful
bidder.Because the product has now been taken over "ex warehouse", it is necessary for the
successful bidder to make arrangements for the handling of the squash hence forth.


+++ Using the TSC Web Auction Site +++

In order to utilise this web site service, it is necessary for one to have read and agreed with the site's
terms, and registered as a member.Those who have read the terms and wish to become members,
please click on "Register" on the Menu Bar.


+++ Exhibiting Product +++

If you wish to exhibit product it is necessary to notify User Support by email.Please send an email to
User Support stating your intention to register as a member and exhibit product.After receiving your
email, User Support will reply with several questions to fill out relating to exhibiting product.On receiving
your reply, it will be processed and you will then receive notification of your membership and upcoming
auctions.Once you have signed up for an auction, you may only cancel within one week of shipment.


+++ Notification of the Auction Date and Time +++

The details of the auction schedule (date/time etc) will be posted on the website (click "Product" on
the Menu Bar) and emailed to site members three times.

   1st Notification :
   Up-to-date information at the point in time when the shipment of the lot is verified.

   2nd Notification :
   Up-to-date information at the point in time when the squash arrives at the Japanese port.

   3rd Notification:
   Up-to-date information at the point in time when the inspection of the squash is complete.

Members will be notified any time supplementary information is available about the squash.

TSC Web Auction will do it’s best to provide members with up to date information on the squash lots
.In some cases technical difficulties in either country may disrupt communication by email, so for
guaranteed information, please check the home page on the Auction Website.


+++ The Auction Start Date/Time +++

The Auction Start Date/Time is decided based on the arrival and customs clearance schedule of the
product. All stated dates and times are "Japan time"

   Opening 9.15am.
   Opening 13.15pm.
   Opening 17.15pm.

When there is more than one lot of squash to be exhibited, subsequent lots will begin at 5 minute
intervals to the original start time.


+++ Auction Time Limit +++

The time limit for each auction is 5 minutes.The auction will close once 5 minutes has elapsed.
However, when there is a bid placed within 2 minutes of the end of the auction, time is extended for
another 2 minutes.This pattern will continue until there are no more bids and the clock runs out.
The auction ends once this “extension time” is up.When the time is up, the buyer with the highest
bid at that time will be declared the winner.


+++ The Auction Start +++

When the date and time of the auction arrives, the product can be viewed by clicking "Auction" on
the Menu bar.By clicking on the Product Title you can advance to the bidding page for that product.


+++ Bidding +++

Current bidding on exhibited lots is reserved for Japan based customers only.Foreign based members
cannot bid on exhibited lots.


+++ As the Auction Progresses +++

You can view the details of live auctions in progress by clicking on "Auction" on the Menu bar, then
selecting the product.These live auction details can also be viewed by people who are not members of
the TSC Auction Web Site.


+++ "In Progress" Auction Updates +++

The "Auction Site" webpage refreshes itself every several seconds. You can therefore consistently
view the most up to date auction/bidding information.However, we are not able to guarantee this
"refreshing" function.For up to date progress, please press the "refresh" button on your internet
browser.


+++ Notification of a Successful Bid +++

When the auction time expires, the holder of the highest bid becomes the successful buyer of the lot.
If there are two bids of the same value, the buyer who submitted his/her bid first will be declared the
winner.

The TSC Auction Website will notify the successful bidder of their win and the final bid price by email
after the auction.The successful amount will be the final unit price x the lot weight x consumption tax.


+++ Transferring the Successful Bid Amount +++

The successful bidder is obliged to transfer the successful bid amount (bid price x lot weight x
consumer tax) after the auction is closed.The successful bid amount must be transferred to the
designated account within 36 hours of the close of the auction (not including weekends or public
holidays)This transaction is subject to TSC Web Auction commission.

As soon as the bank has confirmed the receipt of the funds, the ownership of the lot is transferred
to the successful bidder. An email clearly stating this “TSCWA Transfer Notice” will be sent to the
successful bidder.


+++ Canceling a Successful Bid +++

If you wish to cancel your successful bid you must do so within 24 hours of the auction.Please notify
User Support of your intention to cancel your winning bid.The Cancellation Penalty will be calculated
by the difference between the original auction winning bid and the re-auctioned winning bid x the weight
of the lot involved + consumer tax
.


+++ The Cancellation Penalty +++

If TSC Web Auction does not receive the remittance of auction funds into its designated account
within 36 hours of the auction close (excluding weekends and public holidays) - the successful bidder
will be deemed to have cancelled the contract.

Those who cancel auction contracts without permission will have their names added to "Blacklist"
on the Menu Bar, along with others who breach the Auction Site’s regulations.Until the cancellation
charge is verified ? the website will continue to display the original auction winner’s name.The
Cancellation Penalty will be calculated by the difference between the original auction winning bid
and the re-auctioned winning bid x the weight of the lot involved + consumer tax
.


+++ Remittance of Funds to the Exhibitor +++

Funds from a successful auction will be remitted to the exhibitor within 60 hours of the close of
the auction.Should a bidder cancel out of his/her contract post auction,TSC Web Auction will still
be liable to pay the exhibitor the funds due from the auction.


+++ Handling the Squash +++

From the instant ownership is transferred the squash becomes the property of the successful
bidder.Because the product has now been taken over "ex warehouse", it is necessary for the
successful bidder to make arrangements for the handling of the squash hence forth.As far as the
location of the squash lots are concerned - you will find the details of the storage location
(warehouse) and the management code in the email you will receive from TSC Web Auction
notifying you of the product list and auction schedule.


+++ Warehouse Storage +++

The cost of storage for the first two weeks is free starting from, and including, the day where
ownership changes.Once two weeks have passed, there is a delay fee involved.The first week
is incurred at 2 yen /kg, and each week after that is charged at 1 yen per kg.We reserve the rite
to enforce this "delay fee".


+++ The Rejection of Product due to Quality Issues +++

TSC Web Auction gives a margin of error of 3% when notifying members of product quality.If you
are able to verify a margin of error of greater than 3% within 24 hours of successfully bidding for
the product, please contact User Support immediately.TSC Web Auction staff will consider
discounting the successful bid price once they have verified the facts.


+++ Re-Auctioning Product +++

If the successful bidder cancels their contract for any reason, the lot they had bid on will put up
for auction again.In the case of a re-auction, an email will be sent out to members. You can also
find the information relating to the new auction date and time on the Menu Bar under "Products".


+++ Postponement of Auction due to Quality Issues +++

If product arrives in an undesirable state, time must be given to TSC Auction staff to inspect and
report on the product.This may cause a delay in the Auction start date and/or time.A stringent
quality inspection will be carried out with the new Auction date and time included in the final report
on the product.
